At Hachi, we’re dedicated to protecting the privacy of all our users, especially our younger ones. This Privacy Policy aims to clarify what information we collect, why we collect it, and how we utilize it.

1. SUMMARY

Hachi is not hungry for your personal data. You can sign up without your email address, number, or name. Your questions are stored locally, on your device. Our subscription model allows us to keep the app ad-free, and allows you to subscribe anonymously using your Apple or Google account. Only if you get in touch through the website, https://hachi.bot or otherwise, will we collect and process the personal data that you submit, allowing us to respond to your queries. Hachi is made by Everyday Digital (Pty) Ltd., and makes use of licensed technology. We encourage you to also review the End-User License Agreement (EULA). For further details on how and why we collect and process your data, please refer to section 6.

2. OUR PRIVACY POLICY

We are Hachi (“we,” “us,” “Hachi”), a licensed operator of the Hachi app.

Hachi (the “App”) is developed using technology owned and provided by Everyday Digital (Pty) Ltd. As a User of Hachi (“you,” “User”), your confidentiality and the security of your personal information are important to us.

With a focus on privacy-by-design, we strive to maintain high standards of compliance, transparency, and accountability. This Privacy Policy details how we collect, use, store, process, and disclose your personal data (data that can identify you) when you access or utilize Hachi and/or related products, technology, services, websites, and applications (“services”) provided directly or through a mandated provider of our App.

Originating from South Africa, Hachi adheres to the Protection of Personal Information Act (POPIA) 4 of 2013 (“the Act”) and is also guided by the General Data Protection Regulation (GDPR). This commitment demonstrates Hachi’s dedication to fulfilling its obligations under the Act, as well as meeting the standards set forth in the GDPR.

3. DEFINITIONS AND CONTEXT

3.1 “User” or “you” encompasses anyone accessing or using Hachi and related Apps;

3.2 “Data” means the sum of all information we collect and store through your use of Hachi;

3.3 “Licensor” or “Provider” is Everyday Digital Pty (Ltd) (“we”, “ED”), the primary Licensor and Provider of its technology;

3.4 “Licensee” or “Operator” is Hachi (“we”, “us”) a mandated provider of an App built on the Licensor’s technology;

3.5 “Technology” means proprietary technology, frameworks, software, Apps, and/or Platforms, and related services and processes, as developed by ED;

3.6 “App” means Hachi - an iteration of the Licensor’s technology that is made available to the User on Apple and/or app stores;

3.8 “Account” means a User’s Apple or Google account used to subscribe to the App.

3.9 “Controller” or “Data Controller” means the technology Licensor, and/or Licensee(s);

3.10 “Processor” or “Data Processor” means anyone who has access to your personal information through Hachi and/or is processing such personal information in connection with the use of Hachi.

3.11 “Processing” of personal data can be defined as including any operation or set of operations performed upon personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction;

3.12 “Appointed Provider” is a User who has been appointed as a third-party service provider by a Controller and thus given limited or full permission to access, view, and process personal information of Users. Appointed Providers may offer services such as support, administration, integrations, and content development.

4. DATA COLLECTING AND PROCESSING

We gather limited information about app users, support requesters, and website visitors for various reasons. In this capacity, we operate as both a “Data Controller” — when we collect your personal data directly when you make a website submission, and as a “Data Processor” - when processing data to provide support or fulfill the functions outlined in this policy.

4.1 How We Process Your Personal Data
The way we process your personal data depends on the type of service or request you make, allowing us to provide relevant and legitimate services to you. Here’s how it breaks down:

  • 4.1.1 If You are an App End-User: We collect your IP address, Device ID, Transaction ID, and Subscription ID solely for the purpose of providing you with an anonymous account and app subscription. The data we collect is unable to identify you directly. Only if you explicitly contact us and/or request support through our website and provide us with your personal details, will we collect, store, and be able to link you to collected data (see 4.1.3 and 5.1).

  • 4.1.2 If You are a visitor to our website: We will only collect personal data if you consent to our collection thereof, or if it aligns with our legitimate business interests; this usually occurs when you make an inquiry, contact us, or submit a form. Additionally, we may use cookies to collect analytical data about your visit, such as pages viewed and time spent on the site, which helps us improve user experience.

  • 4.1.3 If you have requested support: We will collect personal data only if you consent to us gathering your information to assist with your support request. For instance, we may ask for your contact details to keep you updated about a reported issue, flagged concern, or technical challenge.

5. DATA WE COLLECT AND WHY WE COLLECT IT

We’ve made sure that you can use our features and services without having to share your personal information. That means your name, email, and location are not collected while you use the app.

However, if you choose to interact with some of our additional services, we may gather a bit of extra information. This helps us provide you with the best support and information, no matter if you’re a regular app user or just exploring what we have to offer. Your privacy is super important to us, and we’re committed to keeping your data safe!

5.1 What We Collect When You Use the Hachi App
When you’re using the Hachi app, we collect a few key pieces of information to enhance your experience and keep everything running smoothly:

  • 5.1.1 Device ID: We gather your Device ID so that we can link your subscription to your specific device. This helps us maintain your anonymous account and subscription, seamlessly.
  • 5.1.2 Subscription ID: Your Subscription ID (which includes your receipt and Transaction ID) is collected to verify your access to our services. This is tied to your Device ID.
  • 5.1.3 IP Address: We collect IP addresses to keep an eye on our services and to protect them from any malicious activities or abuse, and to block suspicious IP addresses if needed.
  • 5.1.4 Data Received: We track the data sent to our services to monitor for potential threats, improve our offerings, and address any issues that arise.
  • 5.1.5 Flagged Issues: If you choose to flag a device log for us to review, we collect specific information to help investigate the issue, including:
    • 5.1.5.1 Question: The question you asked.
    • 5.1.5.2 Answer: The answer you received.
    • 5.1.5.3 Flags: Any flags associated with the question and answer.
    • 5.1.5.4 Comprehension level: The comprehension level set at the time.
    • 5.1.5.5 App Version: The version of the app you’re using.
    • 5.1.5.6 Device ID: Your device ID.
    • 5.1.5.7 IP Address: The IP address of your device.

Rest assured, data collected through the app by our servers is kept for no more than three months, or until your Subscription ID has expired.

5.2 When you request support or contact us from the Hachi website
If you reach out for support or contact us through the Hachi website (https://hachi.bot), we gather a few pieces of information to ensure we can help you effectively:

  • 5.2.1 Email Address: We collect your email address so that we can get in touch with you to assist with your support request.
  • 5.2.2 Your name: You can provide your name in the contact form (whether it’s your real name or a fictitious one) so that we can address you appropriately during our conversation.
  • 5.2.3 Device ID: If your support request relates to an issue with the app, we’ll collect your Device ID to better understand and resolve the problem.
  • 5.2.4 Subscription ID: If your support request involves billing, we’ll also collect your Subscription ID to ensure we have the correct information related to your account.

Your email address and name are not stored on any online services; they are immediately deleted once your support request is resolved.

6. RECIPIENTS OF DATA: HOW YOUR DATA MAY BE SHARED

We want to be transparent about how your data might be shared. Here’s a breakdown of who may access your information:

6.1 Internal Teams Our internal support, administrative, and development teams may access App User information, when submitted. However, this access is strictly for legitimate purposes and not for distribution outside of these necessary functions.

6.2 Legal Requirements: Your personal information may be disclosed by ED if we are required to do so by law or court order. Additionally, if we believe it’s necessary to protect our rights, we may take the discretion to disclose such information.

7. SAFETY OF MINORS

We take the safety and privacy of minors seriously. Here’s what you need to know:

7.1 We do not offer App subscriptions to anyone under the age of 13, or to anyone who qualifies as a minor according to the laws of your specific jurisdiction.

7.2 If you are under the age of majority in your area, you may only create a Hachi subscription with parental supervision.

7.3 If you need consent from a parent or guardian based on your jurisdiction’s regulations, please have them review this Privacy Policy on your behalf.

7.4 We do not intentionally collect personal data from anyone who is a minor. If we become aware that we have inadvertently collected such information, we will delete it promptly and permanently.

8. SECURITY

We recognize the importance of your personal information, and are dedicated to safeguarding it. Here’s how we ensure your data remains secure:

8.1 Commitment to Security: Everyday Digital understands the value of your personal information and takes all reasonable steps to protect it from unauthorized access, misuse, loss, or interference. We continuously review our security measures to maintain the integrity and confidentiality of your data. We also impose the same security standards on third parties with whom your information may be shared, ensuring they uphold these principles as well.

8.2 Security Measures: We have implemented robust security measures to protect your personal data from any potential threats.

8.3 Ongoing Review: We regularly assess our security and privacy practices to keep our systems and services secure. While we strive to prevent any loss, misuse, or alteration of data, we cannot guarantee complete security. However, we are committed to using all reasonable efforts to protect your information.

8.4 Your Role in Security: It’s important for you to take steps to protect your personal data too. Maintain strong passwords and ensure your account, computer, or device is secure from unauthorized use. Together, we can keep your information safe!

9. YOUR RIGHTS

We believe you should have control over your personal information. Here are your rights regarding your data:

9.1 Withdrawal of Consent: You may withdraw your consent at any time by contacting us using the information provided in this policy.

9.2 Cessation of Use: If you stop using Hachi, cancel your subscription, or notify us of your withdrawal of consent, we will cease collecting and processing your personal data.

9.3 Data Retention: To prevent retaining your data beyond its intended purpose, your personal information will be permanently deleted once a support request has been resolved, or a contact engagement has ended.

9.4 Deleting or Editing Your Personal Data:

  • 9.4.1 Rectification or Erasure: Upon your request sent to the Controller and relevant Processor(s), your personal data (including any processed data) may be corrected or erased.
  • 9.4.2 Right to Lodge a Complaint: You have the right to lodge a complaint with a Processor regarding the handling of your personal data.
10. GOVERNING LAW

10.1 Applicable Law: This Privacy Policy, along with any disputes or claims arising from it, is governed by South African Law.

10.2 Invalid Provisions: If any provision of this Privacy Policy is found to be illegal, void, or unenforceable under applicable law or by a competent court, that provision will be considered deleted. The remaining provisions will continue to be in full force and effect.

11. CHANGES TO THIS PRIVACY POLICY

We may update, change, or modify this Privacy Policy from time to time. Any changes or modifications, as well as any additions or deletions, will go into effect immediately upon notification to you. This notification may occur through various means, including on Hachi’s website, via email, in-app notifications, and/or otherwise.

Your continued access to and/or use of Hachi following these changes will be considered your acceptance of the updated Privacy Policy.
